We are very happy to announce that our article on the usefulness of the As Efficient Competitor (AEC) Test in abuse cases has been nominated for the 2019 Concurrences Antitrust Writing Awards. Please read it if you are interested in the positive enforcement of Art. 102, i.e. enforcement based on hard facts rather than prejudice and opinions.
This article discusses how firms can effectively assess whether their practices are likely to restrict competition in a variety of market contexts. It then examines the main questions that remain unanswered as to how the Commission will assess such evidence. It also discusses presumptions in this context.
